Terms of Service

These Terms of Service ("Terms") govern your use of PhonoFlow ("the Service"), operated by PhonoFlow ("we," "us," or "our"). By creating an account, you agree to these Terms.
1. Eligibility
PhonoFlow accounts are available to licensed educators and school administrators. By signing up, you represent that you are authorized to use the Service in an educational context and that you will use it in compliance with all applicable laws and your institution's policies.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@phonoflow.org if you believe your account has been compromised. You are responsible for all activity that occurs under your account.
3. Acceptable Use
You agree to use PhonoFlow only for lawful educational purposes. You may not:
- Enter student names, birthdates, or any personally identifiable information into the Service — Student Codes only
- Attempt to reverse engineer, copy, or replicate the Service
- Use the Service in any way that violates applicable law, including student privacy laws
- Share your account credentials with unauthorized parties
- Use automated tools to access or scrape the Service
4. Student Data and Ownership
PhonoFlow is designed from the ground up to avoid collecting student personally identifiable information. Students are identified only by a short Student Code assigned by the teacher — never by name or any other identifying detail.
You own your data. All Student Codes and assessment results you create remain your property. PhonoFlow stores this data solely to keep your Android app and web dashboard in sync. We do not access your assessment data, analyze your students' results, use it for any commercial purpose, or claim any ownership over it.
Audio recordings captured during assessments are processed in real time for transcription via Microsoft Azure and are never stored on our servers.
You are responsible for ensuring that your use of Student Codes is consistent with your school or district's policies regarding student data.
5. Service Availability
PhonoFlow is provided on an "as available" basis. We do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications at any time and will make reasonable efforts to notify users of planned downtime in advance. Because the Service requires an internet connection, assessments cannot be conducted without connectivity.
6. Intellectual Property
The PhonoFlow application, its source code, design, and content are owned by PhonoFlow and protected by applicable intellectual property law. You retain full ownership of the reading passages and assessment data you input into the Service.
7. Termination
We reserve the right to suspend or terminate accounts that violate these Terms, or for any other reason with reasonable notice. You may delete your account at any time by contacting support@phonoflow.org. Upon termination, your data will be permanently deleted within 30 days.
8. Disclaimer of Warranties
PhonoFlow is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free or uninterrupted, or that AI-generated transcription and scoring will be 100% accurate. Assessment results are tools to support — not replace — professional teacher judgment.
9. Limitation of Liability
To the maximum extent permitted by law, PhonoFlow shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
